Are there any restrictions on the disposal of a land plot received free of charge by decision of the akimat for the construction of an individual residential building? Will it not be necessary to pay its full cost in this case?
If the rights to the plot are formalized and registered in accordance with the established procedure, then the plot is privately owned.
In accordance with Article 25 of the Land Code of the Republic of Kazakhstan, the owner of a land plot exercises the rights of ownership, use and disposal of the land plot at his own discretion without obtaining any permits from state bodies, unless otherwise provided by law. The owner has the right to carry out any transactions with respect to his land plot without changing its intended purpose that are not prohibited by legislative acts of the Republic of Kazakhstan.
For this case, the legislation does not provide for any restrictions on transactions. Therefore, the owner can freely sell the land plot.
However, according to Article 50 of the Land Code, a citizen who sold a land plot will not be able to receive it again for free for individual housing construction.
