Amount and basis of payment in case of death of a civil servant
In accordance with paragraph 5 of Article 24 of the Law of the Republic of Kazakhstan "On Civil Service", in the event of the death of a civil servant, his family members are paid a one-time benefit in the amount of 3 average monthly salaries at the last place of service in a government agency, while the amount of the benefit cannot be lower than that established by the legislation of the Republic of Kazakhstan. Clause 3-1 of Article 6 of the Law of the Republic of Kazakhstan "On state social benefits for disability, loss of breadwinner and old age in the Republic of Kazakhstan" provides for a one-time payment for burial in the event of death to a family member or the person who carried out the burial, in the amount of 15.7 monthly calculation index.
Who is eligible for benefits?
A literal interpretation of the said norm of the law leads to the conclusion that the said benefit is paid to any family member , regardless of cohabitation with the civil servant, in contrast to the cases specified by other norms of the law. For example, paragraph 3 of Article 24 of the Law "On Civil Service" states that civil servants and members of their families living with them enjoy medical care in the appropriate state health care institutions in accordance with the established procedure. In this case, the law clearly limits the circle of persons to whom a certain right belongs.
